You must read through the entire Terms of Service below and agree with all the details before you use any of our Services.

23VIP srl is a company registered in Belgium, VAT BE0849690306. Postal address: 1b, rue de la Grande Bruyère, 1330 Rixensart, Belgium.

Default operating mode: 23VIP processes all drafting requests through sovereign open-source models hosted entirely in Europe by European providers. These default models never retain or train on your data and keep every interaction inside the EU. Commercial models such as OpenAI, Anthropic, and Google (Gemini) remain available only on explicit demand and can be disabled per user or organisation.

Two Categories of Data

These Terms govern two distinct categories of data. Where the rules differ, each section below states explicitly which category it addresses. Full definitions and protections are set out in our Privacy Policy.

Invention Data — the technical content you submit to and receive from our drafting tools, including invention disclosures, claims, patent specifications, drawings, and draft outputs.

Account Data — personal and administrative information such as your name, email address, company name, billing address, VAT number, payment transactions, login credentials, and usage information.

Acceptance of Terms

By using 23VIP's website or software services ("Services"), such as Web Drafter or Claim Drafter, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services. Please keep a record of these Terms.

The Services are provided by 23VIP srl ("23VIP," "we," "our," "us"). "You" and "your" refer to you as a user of the Services. If you are agreeing to these Terms on behalf of a law firm, company, or other entity, you represent that you have authority to bind such entity, its affiliates, and its associated users to these Terms, in which case "you" and "your" shall refer to such entity, its affiliates, and its associated users. If you do not have such authority, you must not agree to these Terms and may not use the Services.

Use of Services

  • The Services are designed to assist in preparing patent applications but are not a substitute for the advice of a qualified patent attorney. You acknowledge and agree our Services are not provided as part of an attorney-client relationship and using our Services does not give rise to an attorney-client relationship. Information you receive from us does not constitute legal advice and is not a substitute for obtaining legal advice from a qualified patent attorney.
  • You must be 18 years or older to use the Services or have obtained parental consent.
  • You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purposes in accordance with these Terms.
  • Ownership of Invention Data: You retain full ownership of all Invention Data you submit to the Services. By using the Services, you grant 23VIP only the limited, transient right to process your Invention Data for the sole purpose of generating the drafting output you requested. This right expires the moment the session ends. 23VIP acquires no other rights over your Invention Data.
  • You may not manually or systematically download or scrape content from 23VIP's website or Services, or write scripts to do so.
  • You may not use our Services to reverse engineer the software or underlying code used to provide our Services.
  • You may not use our Services to violate any law or regulation.
  • You may not use our Services to violate other people's intellectual property, privacy, or any other legal right.

Intellectual Property

23VIP retains all intellectual property rights in the Services, including all software and underlying technology. You may not reverse engineer or attempt to extract the source code of the Services.

For the avoidance of doubt: 23VIP claims no intellectual property rights over your Invention Data. All rights to the inventions, claims, specifications, and outputs remain exclusively yours.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials (Account Data). You agree to accept responsibility for all activities that occur under your account. We strongly recommend that you enable two-factor authentication ("2FA") from your account settings. When 2FA is enabled, a one-time verification code is required in addition to your password. 23VIP reserves the right to deactivate or terminate your account at any time for any reason, including violation of these Terms.

Payment and Refunds

The Services are provided on a pay-per-use basis. Payments are not refundable. We reserve the right to modify prices at any time. Changes will not be applied retroactively but will apply to future use of the Services.

Data Security, Confidentiality, and Privacy

At 23VIP, we prioritise the security, confidentiality, and privacy of your data. Full details are set out in our Privacy Policy. Below is a summary of the key protections, organised by data category.

Protections Applying to All Data

  1. Secure Transmission: All data — both Invention Data and Account Data — is encrypted using TLS 1.3 in transit.
  2. Encryption at Rest: Any temporarily stored data is encrypted using AES-256.

Invention Data

  1. Default Processing: Invention Data is processed by sovereign open-source models hosted in Europe in the default path. That path is configured not to use your data for model training and is intended to keep processing within EU-hosted infrastructure.
  2. Zero Access: 23VIP personnel have zero access to your Invention Data inputs or outputs across all drafting tools.
  3. Zero Retention: In the default mode, Invention Data is processed in real time and is not stored after the session ends.
  4. Optional Commercial Models: If you or your organisation explicitly choose a commercial model, your Invention Data may be processed by OpenAI, Anthropic, or Google (Gemini) under business terms that prohibit training. Policy references:
  5. Document Delivery: Generated documents are delivered directly to your browser when ready and are not retained by 23VIP for later retrieval.

Account Data

  1. Processing: Account Data is processed by 23VIP's application logic on a trusted European-hosted cloud platform. Account Data is never sent to the AI models.
  2. 2FA: Optional two-factor authentication adds a verification code to your login process, protecting Account Data access.
  3. Subprocessors: Account Data may be processed by our payment processor and European cloud hosting provider, each bound by contractual confidentiality obligations.

By using our Services, you acknowledge and agree that your data will be processed as described above and in our Privacy Policy.

Disclaimer of Warranties

The Services are provided "as is" without warranty of any kind, express or implied. 23VIP disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

You acknowledge and agree that we make no guarantees or warranties on the outcome of your patent application or on the quality of our output, including the generated language, revisions, comments, or any other output provided by our Services. You acknowledge and agree that you are using our Services solely at your own risk.

23VIP's Services are provided "as is" to the maximum extent permitted by applicable law. We expressly disclaim all warranties and conditions of any kind, whether express or implied, including but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement. We specifically do not represent or warrant that 23VIP will meet your requirements, will be accurate or reliable, or will be error-free. No information or advice, whether oral or written, given by us, shall create any warranty not expressly provided in these Terms.

To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including but not limited to any loss of business profit, any loss of goodwill, any loss of data, or the cost of procurement of substitute goods or services) that may arise from using our Services. We shall not be liable for such damages whether or not we have been advised of or should have been aware of the possibility of any such losses arising.

Indemnification

You agree to indemnify and hold 23VIP harmless from any claim or demand made by any third party due to your use of the Services in violation of these Terms or any applicable law.

Law and Dispute Resolution

These Terms will be governed by the laws of Belgium without giving effect to any conflict of laws rules or principles. You agree that any legal action related to these Terms or Services will be filed only in Belgium. You agree to submit to the personal jurisdiction of such courts. If any provision in these Terms is found unlawful or unenforceable, that provision will be removed and will not affect the enforceability of any other provisions. Our failure to enforce any right arising from these Terms will not constitute a waiver of that right or prevent us from enforcing that right in the future.

Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force. 23VIP's failure to enforce any right shall not constitute a waiver of such right. You may not assign these Terms without 23VIP's prior written consent.
