Reply Drafter — AI Office Action Response Software
Reply Drafter analyzes patent office actions against the cited prior art and drafts complete, filing-ready replies. It imports your patent file automatically from the EPO and USPTO registers, forms its own opinion on patentability before reading the examiner's, and works through the response phase by phase, with your review at each step. Reply Drafter runs exclusively on frontier models: Gemini by default, with Claude Opus and GPT selectable.
How It Works
Automatic Patent Import
Enter an EP, WO, or US application or publication number and Reply Drafter fetches the file for you: the application as filed, the current claims, the office action, the cited prior art documents, and the priority documents — retrieved directly from the EPO and USPTO registers and filed into the right places automatically. For EP cases, a fallback path also retrieves register-only documents that the standard APIs cannot return on their own, including office actions, search opinions, replies, and scanned priority documents — even unpublished US provisional priority documents.
Multi-Phase Legal Analysis
Reply Drafter works the way a careful attorney does — in sequence, with your review at each step:
- Prosecution history: claim evolution, examiner patterns, and which past arguments worked or failed
- Priority: which claim features are entitled to the priority date
- Support / added matter: basis of the claims in the application as filed
- Clarity: claim wording objections before they arise
- Novelty: each prior art document analyzed on its own first
- Inventive step: combinations assessed after individual documents
- Patentability workup: the complete independent assessment of every independent claim
- Examiner comparison: where the examiner is right, where the position is rebuttable, and where there are factual errors
- Client reply check (optional): if you already have a client's proposed reply, evaluate it against the analysis and get a recommendation to adopt it, adapt it, or replace it
- Fallback generation: amendment options built thoughtfully, one considered feature at a time, from the dependent claims, description, and drawings
- Fallback ranking: every option scored against the prior art so you choose from ranked positions, not guesses
Two Deliverables
- Client Opinion Report: a comprehensive assessment with strategy and recommended amendments — it works with or without an office action, so it also serves pre-filing and freedom-to-respond studies
- Formal Reply Letter: a filing-ready response to the examiner, with amended claims presented as track changes — drafted section by section with your sign-off on each argument, or in one go
Model Selection
Reply Drafter works exclusively with frontier LLMs: Gemini (default), Claude Opus, and GPT. Unlike Claim Drafter and Web Drafter, it has no EU-hosted open-source path — the depth of multi-phase legal reasoning it performs requires frontier-class models. All providers are used under business terms that prohibit training on your data. See our Privacy Policy for details on data handling per model path.
Built for Prosecution Practice
| Feature | What It Does |
|---|---|
| Jurisdiction Profiles | EP, US, PCT, BE, CN, JP, KR, IN, CA, AU — the selected jurisdiction's law is applied to every phase and output |
| Track-Changes Review | Amended claims and chat edits are presented as track changes you accept or reject individually |
| Chat Refinement | Discuss any phase output, challenge the reasoning, and apply reviewed edits |
| Durable Workspaces | One project per case; documents, analyses, and drafts are saved so you can return weeks later |
| Related Project Context | Reuse documents or completed analyses from another one of your projects — e.g. a related EP filing — as read-only context, without re-uploading |
| Per-Document Controls | Exclude a specific document from the analysis without deleting it, or chat with just that one document |
| Templates & Style Profiles | Upload your firm's .docx reply and opinion-letter templates and your own past replies into a personal, reusable library — drafts follow your format and your drafting voice, with multiple named style profiles to switch between per case |
| Voice Dictation | Every instructions and chat box has a microphone button, with EU-hosted transcription |
Why Patent Attorneys Choose Reply Drafter
An Independent Opinion, Not an Echo
Reply Drafter analyzes the cited prior art itself — each document alone, then in combination — before it reads the examiner's reasoning. The comparison then shows you exactly where the examiner's position holds, where it is rebuttable, and where it misstates the references.
Control Over Every Phase
- Review and edit each phase's output before the next phase builds on it
- Decide at the comparison stage: defend the claims as filed, or amend from ranked fallbacks
- Fallback amendments build one carefully considered feature at a time, not a scattershot combination list, so every position stays clean and arguable
Confidentiality
Reply Drafter processes your prosecution documents with frontier models under business terms that prohibit training on your data.
- Gemini, Claude, and GPT are used under no-training business terms
- Reply Drafter is designed to prevent internal access to your inputs and outputs
- Designed with GDPR requirements and European hosting considerations in mind—23VIP is a Belgian company with European hosting for the application layer
- Organizations can restrict which model families their users may select
- Drafting-style profiles capture tone, structure, and phrasing only, keeping case-specific content out of the saved profile

Frequently Asked Questions
How is Reply Drafter different from ChatGPT for office actions?
Reply Drafter is purpose-built for prosecution: it imports the actual file from the EPO or USPTO register, analyzes each prior art document separately before combinations, applies the selected jurisdiction's law, and produces a formal reply letter with track-changes amended claims. A general chatbot does none of this and cannot show you where the examiner misread a reference.
Which offices and jurisdictions are supported?
Automatic import covers EPO and USPTO files. Jurisdiction profiles cover EP, US, PCT, BE, CN, JP, KR, IN, CA, and AU — the profile controls the legal framework applied in every phase, and outputs can be generated in your chosen language.
Do I need an office action to use it?
No. The Client Opinion Report compiles the complete patentability analysis with or without an office action, so you can also use Reply Drafter for pre-filing assessments. The formal reply letter itself requires the office action you are responding to.
Can I check a client's own draft reply?
Yes. Upload it during project setup and run the client reply check after the examiner comparison — Reply Drafter evaluates it against the analysis and recommends whether to adopt it, adapt it, or draft a replacement.
Which AI models does Reply Drafter use?
Reply Drafter runs exclusively on frontier models (Gemini by default, with Claude Opus and GPT selectable); it has no open-source path. All providers are used under business terms that prohibit training on your data.
What does it cost?
Pay per use: 0.4 credits (40 EUR) buys 24-hour unlimited use, the same as Claim Drafter, with no subscription required. Or subscribe for €199/attorney/month (€1,999/year) covering unlimited use of all three 23VIP tools.
